Fox News Contributor Says Preliminary Hearing Evidence Points to Charlie Kirk Assassination Suspect as Family Seeks Justice

A preliminary hearing in the assassination case of Charlie Kirk began Monday in Utah, where prosecutors are seeking to move forward with charges against Tyler Robinson, the man accused of fatally shooting the conservative activist on a Utah college campus last September.

Robinson has not yet entered a plea to the aggravated murder charge. The hearing is focused on whether prosecutors have established probable cause to proceed to trial, where a jury would ultimately determine guilt or innocence under the higher legal standard of beyond a reasonable doubt.

During Fox News coverage of the proceedings, contributor David Webb argued that the evidence presented so far indicates Robinson carried out the killing, while emphasizing the importance of allowing the judicial process to continue.

Fox News host Sandra Smith reflected on the emotional scene inside the courtroom, noting that Kirk’s widow, Erika Kirk, appeared to make eye contact with the judge as proceedings got underway. Smith remarked on the difficult legal battle the family has faced, including defense efforts to delay the case and attempts to limit media access to the courtroom.

Smith also referenced Erika Kirk’s statement that “The public should see this,” highlighting her belief that the case should remain open to public scrutiny.

Webb agreed, saying the assassination occurred in public and is therefore a matter of significant public interest. He also addressed legal disputes surrounding the case, including defense efforts to remove the possibility of the death penalty.

According to Webb, prosecutors should retain every available option during the case, describing the death penalty as a legitimate negotiating tool. He also suggested that delays and other defense strategies could be intended to introduce doubt into public perception of the case or influence the jury process.

Webb said that, based on the evidence presented during the preliminary hearing, he does not believe the central question is whether Robinson committed the act, but rather what punishment may ultimately be appropriate if he is convicted. He also noted that hearsay testimony was being allowed through statements from Lance Twiggs, Robinson’s roommate and romantic partner at the time of Kirk’s death.

Webb argued that the public has a strong interest in observing the proceedings, pointing to other high-profile assassinations throughout American history and saying justice should not only be carried out but should also be visible to the public.

Smith responded simply, saying, “Yeah, amen to that.”

The courtroom was filled with members of both families during Monday’s hearing. Robinson’s parents attended the proceedings, as did Charlie Kirk’s parents, his sister, and his widow. Also present was Donald Trump Jr., who was a close friend of Kirk.

Following the hearing, Kirk’s family released a statement describing the continued emotional toll of the case.

“Charlie was a beloved husband, son, brother, friend, and father,” the family said. “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children.”

The family also expressed gratitude for the prayers, support, and kindness they have received since Kirk’s death, saying that encouragement has sustained them through what they described as the darkest days of their lives.

The statement concluded by asking for privacy as the legal proceedings continue, adding that the family would not be making any further public comments.
